Hello all,
 
This is my first time posting to this forum.
 
Last Saturday I went out and purchased a new 2007 CBR 600 RR. The bike was delivered yesterday and I must say that these are awesome motorcycles.  This is not my first street bike. I have owned a Katana 600 and a GS500.
 
Well the unthinkable happened. I was driving through a school zone (At 20 MPH) and an 81 year old gentleman pulled from an alley making a left hand tune into my right of way. I was unable to stop in time and collided with the rear of his truck. The officer found the guy at fault and he does have insurance.
 
I took the bike to the dealer where purchased. They said that the bike would not be totaled but that over 3k worth of damage had been done. The bike only has 87 miles on it and I have real concerns with owning a bike that is capable of going 150MPH+ that has been repaired. What if I decide to take it to the race track? What kind of stability/dependability will I get from the bike? I would like to INSIST that they total out the bike but I’m not sure what I should do.
 
I would like to hear your opinions.

I would tell the guys insurance you want a new bike cuz that is what you had!

Have you already showed him the estimate? If not, take the bike home, beat it up some more and take it to a different dealer.

That bites.  What nasty luck.  3k in damage is probably not that much damage -- I bet it's all fairings.  If you get it fixed it will be perfectly fine to keep riding.  No need to do 150 MPH on though!

I'm in no way interested in doing anything deceptive such as inflicting additional damage for them to fix BUT, I do feel that they should make sure the bike is in "AS  NEW" condition. I know they can make the bike look good but what about what you can’t see? What if one or both of the forks are slightly bent (or rim) this is not something they will replace unless it’s obvious. Sometimes problems like this are speed sensitive.

you only have 87 miles on it, if you can show it - you should be able to get a new bike.. you can repair a car and not have to worry about stability that much (it's got 4 wheels) but this is 2 wheels, what if it always leans to the left more for now on? you just bought it and insured it.. It's the insurance problem and you deserve a new bike, they can chop that bike out and make more than the wholesale is worth.
 
it sucks that your bikeless intill then but thank god your alright because that is the most important thing, the bike comes second.. be safe and stay away from old people..

My buddy took his bike in for an estimate after he was in an accident. The shop he took it to looked for the smallest scratches on the bike. If they found a scratch, they quoted him for the replacement of the entire panel. Maybe find a shop that does that kind of thing.

IANAL, I didn't stay at a Holiday Inn last night either! (ok, lame joke!)

I just went through a similar incident where a nice ederly man rear ended my 4 month old S2000 with extremely low miles (3rd car). The fight with insurance was nasty. I wanted a new car, it took me lawyering up and six months to get it.

Here are some things I would try:
1) go get a checkup from the Dr.
2) there may be $3k in damage, but some states allow "diminished value". Basically, your motorcycle is worth less on the market now because it was damaged. Even if it is fixed, it will never be worth the same as it would have been had it not been damaged. This "diminished value" + the repair charges may be enough to push his insurance company to total the bike and get you a new one.

Again, his insurance company may be nice, consider that they are getting off cheap by giving you a check for a new bike as well. I would not count on that!

Take it to another shop and get another estimate.  Tell the shop you want a new bike and see what they can do in terms of jackin' up the estimate or deeming it unrepairable.

just make sure they run the bike through computrack to see everything is straight...you'll be fine...

Screw that. It'll never be right again, no matter what. I guarantee that both fork legs are bent, the steering head bearings took quite a beating and the triples are probably compromised too. Yeah, it'd probably ride ok with new parts, but there will always be more damage than what you know about or the geniuses at the dealer.
 
If a bike is lowsided = usually just as it was mechanically and back to normal
If a bike is highsided bad = all hosed up
Any collision of decent speed = never the same
 
I highsided mine last year and had it trailered back to my house for MY OWN inspection. Aside from body and cosmetics, the subframe was bent and the frame had a small mark on it. I flipped it who knows how many times and it was done. I made sure it was done too. I did not want that back even after "all fixed" I took a sledge hammer to the frame to make sure there was no question about it.
 
If this was a few years old with high mileage or whatever, I'd be one thing. But a brand spanking new bike with 87 miles on it...I'd get a lwayer and get a new bike. This is going to get really nasty too with the insurance co.

I had a similar thing happen to me. Guy pulled out right in front of me and hit him broad side. Went clear over the handlebars and his hood, right square on my back. I thought the bike would be totaled and really wanted it to be but it wasn't. Got a check for about $4500 and fixed it myself for about a grand. Didn't fix small things like scratched starter cover but did have the chance and money to mod it a bit. Forks are fine, bike rides as good as new and I was probably going faster than 20. You can want a new bike all you want but probably will never get it. If they can fix it cheaper than totaling it, that's what they will do. If it was totaled, you wouldn't get a new bike anyway, you'd get the depreciated value of it and loss money. Take the extra money, after YOU fix it and buy some extras for your bike. You'll learn a lot about your bike in the process, I sure did. Also, see if you can get a new helmet out of it cause it's now "wasted" do to the fact it was hit. It worked for me, an extra $450! sorry for what happened, glad you're ok. My suzuki (not gixxer, suv lol) was sideswiped by a guy who ran a red light. it was right in front of a cop. and of course the cosmetic damage was repaired but my steering is way off (which is not obvious) veers to the left and isnt the same. the insurance said if i can prove its caused by the accident, etc.. i'd have to pay $800 to take the steering apart to have it checked.. it ran on rails before the impact. anyway, i agree taking it to other shops to get higher estimates might help to get it totaled. or i dont know how much it costs but maybe a shop that specializes in frame jigs.

i think the ins. co. will only total a new bike if the repairs exceed 60% of the total cost. get a lawyer and sue the guys ins. co.  insurance company's will always try to play hardball at first, but when they realize they are gonna end up in court, they will usually try to settle out. also, probably wouldn't hurt to say your neck hurts or something(make sure you go to the doctor a bunch of times) voila, new bike!

whenenever you are involved in an accident (auto or motorcycle..etc) 1st thing is goto the DR. get fully checked out. 2ndly take your bike to atleast 3 different shops and get full estimates (also doesnt hurt to take it to a friends shop and have them up the quote for you)

It's been two days since the crash. I spoke with the insurance adjuster but they have not looked at the bike yet. I have not received the estimate for the repair costs. Someone posted about claiming for "diminished value" and I like this idea a lot. I will try to take some pictures but I left it at the dealers stating I wanted them to fix it. I called the dealer yesterday expressing my concerns asking how they can guarantee that the forks, frame, triples, ect are not slightly bent. When I spoke with the adjuster over the phone the same concerns were expressed. All she would say was it could be “REPAIRED" at any shop. I told her that I'm going to be extremly difficult to deal with over this..
 
As for a DR visit, I'm not going to go. Its been 48 hours and I'm OK, a little road rash on my shoulder.

Be careful with that "added damage" approach. That's called insurance fraud, and jail time await those caught doing that stuff.
 
The above poster is right though...the insurance company is obligated to put your bike back into the condition it was in - it wasn't new, but it was very close. Insist on every part with a little tiny scratch be replaced, and that every possible test possible is done to assure that every single part works perfectly. Have the shop include the estimated labor and other charges from all of the checking in the estimate - the labor alone could total the bike.
 
As you say, you bought a bike that you could trust to run 150+ on the track - and that's exactly what you should get back.
 
Don't let them wear you down...your patience and stubborness will be what gets you what you want. They want to get out as cheaply as possible, and they will if you let them.

I got hit in our van this past winter,  the guy had no license but had insurance.. you would not belive the fighting I had to do just to get a little fender bender fixed.  took for ever.   my insurance company even was calling his..  I was days away from taking them to court!!!  we even had to file a claim with the state against the insurance company.. 3 days later they called and said a check was on it's way

Good luck....a new bike should be the only acceptable resolution. A bike with less than 100 miles is still BRAND NEW in my opinion.

Put it in the back of a truck go to an empty road where there is no witness get going about 40 and push the ****er out the back......If it isn't to the totaled state yet it will be after that spill. Then go to a different dealer and get the quote and Voila! Totaled bike!!!
 
 
When a guy ****ed with my bike  i told the guy at the dealership what happened and he went over that bad boy with a fine toothed comb! He also thought it was bullshit and aided me in nailing that bitch for every penny i could.
